8. Right of Withdrawal
A Consumer has the right to withdraw from a distance contract within 14 days, unless a statutory exception applies.
The 14-day withdrawal period is counted from the date of contract conclusion for digital service contracts.
To exercise withdrawal, send an unambiguous statement to [email protected] or by post to: Jakub Burzynski, Aleja Partyzantow 10c/1, 47-224 Kedzierzyn-Kozle, Poland.
You may use any clear wording, for example: "I withdraw from the contract dated [date] regarding [service name]."
If the digital service has not started, the refund covers all payments received from the Consumer for that contract.
The withdrawal right is lost once the digital service has been fully performed, if performance started with the Consumer's explicit prior consent and acknowledgment of withdrawal-right loss.
If performance started before withdrawal, the Consumer bears proportional costs for the part of the service already provided, where required by applicable law.
9. Withdrawal and Refunds
If a digital service starts before the withdrawal period expires, based on explicit Consumer consent and proper prior information about withdrawal consequences, the statutory withdrawal right may be limited to the performed part of the service.
Regardless of the above, the service provider allows a proportional refund for unused premium time, upon a valid refund request or complaint submission.
Formula: (total transaction amount / 30 days) x number of full days remaining on the date of a valid complaint/refund request.
For formula purposes, remaining days are counted as full calendar days and rounded down.
If a refund is approved, funds are returned no later than within 14 days using the original payment method, unless another method is required by law or technically necessary.
10. Maintenance and Technical Interruptions
Planned technical maintenance or emergency service interruptions may temporarily limit access to features, including premium features.
Where feasible, maintenance windows are announced in advance through available communication channels.
11. Complaints
- Complaints can be submitted to [email protected].
- A complaint should include account details, problem description, incident date, and requested resolution.
- Complaints are handled without undue delay and no later than within 14 calendar days from receiving a complete submission.
12. Liability
The service provider delivers services with due care but does not guarantee uninterrupted Platform availability.
To the extent permitted by law, liability for indirect damages, lost profits, or losses resulting exclusively from third-party infrastructure outages is excluded.
Liability limitations do not apply where mandatory law provides otherwise, including in relation to Consumers.
13. Final Provisions
Agreements concluded under these Terms are governed by Polish law, subject to mandatory consumer protection rules.
Disputes may also be resolved out of court, including via the EU ODR platform: https://ec.europa.eu/consumers/odr
