These Terms of Service ("Terms") govern the use of the ZENWAVE.NET platform and all related services. By using our services, you accept these Terms in full. Please read them carefully before using the platform.
1. Definitions
In these Terms, the following terms have the following meanings:
- "Platform" or "Zenwave" – the ZENWAVE.NET technology ecosystem including all services, applications, infrastructure, and tools offered by the operator
- "User" – a natural or legal person using the Platform
- "Account" – an individual account created by the User in the Zenwave system
- "Content" – any data, files, or information uploaded or stored by the User on the Platform
- "Services" – all features, tools, and resources provided by the Platform, including Cloud, Bare Metal, applications, API, and integrations
- "Operator" – the entity managing and providing services within ZENWAVE.NET
2. Acceptance of Terms
By using the Zenwave Platform, you confirm that:
- You have read and understood these Terms
- You are at least 18 years old or have the consent of a legal guardian
- You have the right to enter into binding agreements under applicable law
- The information you provide is true and up to date
- You will comply with all provisions of these Terms
If you do not accept these Terms, you may not use our Services.
3. Registration and Account Security
3.1. Creating an Account
To use the full functionality of the Platform, you must create an Account. During registration, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your data
- Not share your account with others
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access
3.2. Authentication
Zenwave supports the following authentication methods:
- Standard login (email + password)
- OAuth 2.0 (Google, GitHub)
- Multi-factor authentication (2FA) – recommended
- JWT (JSON Web Tokens) for API access
3.3. Account Responsibility
You are fully responsible for all activities performed from your Account. The Operator is not liable for losses resulting from unauthorized use of your Account.
4. Services and Availability
4.1. Scope of Services
Zenwave offers the following categories of services:
- Infrastructure – Cloud Computing, Bare Metal Servers, Virtual Private Servers
- Applications – Web, mobile, and desktop productivity tools
- Integrations – Connections with external services (Google, GitHub, Przelewy24)
- Storage – Secure data and file storage
- API – Programmatic access to Platform resources
- Support – 24/7 technical assistance
4.2. Service Availability (SLA)
We commit to:
- Maintaining Platform availability at 99.9% monthly
- Performing scheduled maintenance with 48-hour notice
- Minimizing downtime and responding quickly to incidents
- Backing up user data daily
In case of SLA breach, Users may be entitled to compensation according to separate SLA agreements.
5. Payments and Billing
5.1. Payment Models
Zenwave offers flexible payment models:
- Pay-as-you-go – pay for actual resource usage
- Subscriptions – monthly or annual plans with set limits
- One-time payments – purchase of specific services or packages
5.2. Payment Methods
We accept the following payment methods:
- Przelewy24 (payment cards, bank transfers, BLIK)
- Invoices for business clients
- Internal Zenwave Wallet
5.3. Invoicing
- Invoices are generated automatically for each transaction
- Invoices are available in your account panel as PDF
- Invoice data can be updated in account settings
- Invoice payment period: 14 days from issue date
5.4. Payment Delays
In case of payment delay:
- You will receive a reminder 3 days before the due date
- After 7 days of arrears, services may be suspended
- After 30 days, the account and data may be deleted
- Statutory interest may be charged
6. User Content
6.1. Content Ownership
You retain full ownership of all Content you upload to the Platform. Zenwave does not claim any rights to your Content.
6.2. License to Operator
You grant Zenwave a limited, non-exclusive license to:
- Store your Content on our infrastructure
- Process Content to provide Services
- Create backups
- Display Content according to your settings
6.3. Prohibited Content
It is forbidden to upload Content that:
- Infringes copyright or intellectual property rights
- Is illegal, harmful, or offensive
- Contains malware, viruses, or malicious code
- Violates the privacy of others
- Is used for spamming or phishing
- Promotes violence, hatred, or discrimination
7. Acceptable Use
By using the Platform, you agree to:
- Comply with all applicable laws and regulations
- Not disrupt the operation of the Platform or infrastructure
- Not attempt to gain unauthorized access to systems
- Not use the Services for unlawful activities
- Not excessively burden Platform resources
- Not duplicate, copy, or reverse engineer Zenwave infrastructure
- Respect the rights of other Users
8. Personal Data Protection
The processing of personal data is carried out in accordance with:
- GDPR (EU) 2016/679
- The Personal Data Protection Act
- Our Privacy Policy

9. Intellectual Property
9.1. Zenwave Rights
All rights to the Platform, including source code, design, logo, and trademarks, belong to the Operator and are protected by copyright law.
9.2. User License
Zenwave grants you a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms.
9.3. Restrictions
You may not:
- Copy, modify, or create derivative works
- Decompile or reverse engineer the source code
- Remove copyright notices
- Sell, rent, or sublicense the Platform
10. Warranties and Limitation of Liability
10.1. Disclaimer of Warranties
The Platform is provided "AS IS" and "AS AVAILABLE". Zenwave does not guarantee:
- Uninterrupted operation of the Services
- Absence of errors or security vulnerabilities
- Compliance with specific requirements
- Accuracy or completeness of data
10.2. Limitation of Liability
To the maximum extent permitted by law, Zenwave is not liable for:
- Loss of data resulting from User actions
- Indirect, incidental, or consequential damages
- Loss of profits, reputation, or business opportunities
- Actions of third parties
The maximum liability of Zenwave is limited to the amount paid by the User in the last 12 months.
11. Suspension and Termination
11.1. Suspension by Operator
Zenwave may suspend your Account in the event of:
- Violation of these Terms
- Suspected illegal activity
- Unpaid invoices
- Resource abuse
- Law enforcement request
11.2. Termination by User
You may at any time:
- Delete your Account from the settings panel
- Request data export (JSON/CSV format)
- Cancel active subscriptions
11.3. Effects of Termination
After you stop using the Platform:
- Your data will be deleted within 30 days
- Backups are deleted after 90 days
- Unused Wallet funds are returned upon request
- Access to the Platform is immediately blocked
12. Changes to the Terms
Zenwave reserves the right to modify these Terms. In the event of significant changes:
- We will notify you by email 30 days in advance
- We will publish the new version on the website
- Continued use of the Services means acceptance of the changes
- You may opt out before the changes take effect
13. Governing Law and Jurisdiction
These Terms are governed by Polish law. All disputes will be resolved by the common courts competent for the Operator's registered office.
Users who are consumers may use out-of-court complaint and redress procedures.
14. Final Provisions
- If any provision of the Terms is found to be invalid, the remaining provisions remain in force
- Failure to enforce any right does not constitute a waiver of that right
- These Terms constitute the entire agreement between the User and Zenwave
- All communication should be in writing (email)
